In Tulare County, a probate case starts with a petition filed with Civil Legal Filings at 221 South Mooney Blvd., Room 201, in Visalia, or at the South County Justice Center in Porterville. Under judicial assignments effective November 2, 2026, probate is heard in Department 2 in Visalia at 8:30 a.m. on Mondays and Wednesdays and in Department 19 at the South County Justice Center at 8:30 a.m. on Thursdays, and the court posts probate examiner recommendations online the day before hearings. A California probate attorney can tell you how those calendars and Tulare's filing deadlines apply to a particular estate.
Filing in Visalia or Porterville, Hearings in Departments 2 and 19
Estates of Tulare County residents land in Tulare County Superior Court, because California administers a resident's estate in the county of domicile, wherever the person happened to die. Its probate department handles decedents' estates, trusts, guardianships of minors and conservatorships of adults, and filing a petition with the Legal Filings Department starts a probate proceeding. Petitions can go to Civil Legal Filings at 221 South Mooney Blvd., Room 201, in Visalia, or to Civil Legal Filings at the South County Justice Center, 300 East Olive in Porterville.
Local Rule 1000(a) assigns probate matters under the court's annual order. Under the assignments effective November 2, 2026, Department 2 in Visalia hears probate and conservatorship matters at 8:30 a.m. on Mondays and Wednesdays, and Department 19 at the South County Justice Center hears probate at 8:30 a.m. on Thursdays. Those assignments can be revised again, and the notice of hearing sent for a petition carries its own date, time and place.
The court's Self-Help Resource Center will not assist with probate of wills and trusts, real estate cases or a request to be appointed special administrator. Advice about a particular estate has to come from a California probate attorney.
Probate Examiner Recommendations and Local Rule 1000 Deadlines
Tulare posts Probate Examiner Recommendations on the same page as its civil tentative rulings, and the court makes all attempts possible to update that page by 3:00 p.m. the day before the hearing. Each matter is listed with a status, using labels such as Recommended for Approval (RFA), Appearance Required or Recommended, and Approval Conditional Upon, and the page directs questions about a listed matter to the Probate Document Examiner.
The local deadlines are counted back from the hearing: moving papers in probate matters at least 15 days ahead, supporting papers at least 10 days ahead, and proposed orders at least five days ahead, except for confirmations of sale and contested matters.
Tulare also keeps watch on estates that stall: if neither a judgment of final distribution nor a status report has been filed within 12 months after letters issue, or 18 months when a federal estate tax return is required, the court issues an order to show cause about the case's status. A California probate attorney can keep track of these dates for a particular estate.
E-Filing and Chapter 10 of the Local Rules
The court accepts electronically filed documents in probate cases around the clock through approved electronic filing service providers, and Local Rule 117 says the court permits e-filing in the case types its website lists. Service providers that want to offer Tulare e-filing contact Journal Technologies.
The probate rules are Chapter 10, Probate Matters, in the local rules revised July 1, 2026; Part One, Rules 1000 through 1006, covers calendars and hearings, contested and ex parte matters, probate referees, accountings and family allowance. For a sale, Rule 1004(b) matters most: inventories and appraisals for sales must come from the appointed probate referee and be filed at least two weeks before any court appearance involving a sale or distribution of the assets.
The court's approved local probate forms deal with guardianships, conservatorships and venue transfers, such as PRO-007, Petition to Transfer Venue of Guardianship or Conservatorship. A change proposed for January 1, 2027, not yet adopted, would modify Rule 1003 on setting ex parte hearings in probate matters, with requests emailed to the courtroom clerks. A probate attorney can say which version of a rule governs a particular filing.
Recording at Government Plaza
Tulare County's Clerk-Recorder now records documents at 5951 S. Mooney Blvd. in Visalia, with filing and recording hours of 8 a.m. to 3:30 p.m., and it accepts mailed requests addressed to the Assessor/Clerk-Recorder there. The office relocated from the Visalia Courthouse on August 31, 2026, keeping its phone numbers and email addresses.
Probate Code section 7263 has the personal representative record a certified copy of any order confirming a sale or distribution of real property, setting apart a probate homestead or determining another matter affecting title, in each county where part of the property lies. Tulare's Recorder takes documents with original signatures or certified copies of the original, and certified copies must be unaltered.
A document affecting a change in ownership must include a completed Preliminary Change of Ownership Report, or a $20 surcharge applies. To prepare for SB 255 owner notices, the Recorder will require an assessor's parcel number on all deeds, deeds of trust and mortgages submitted for recording beginning January 1, 2027. Documentary transfer tax is collected under Revenue and Taxation Code sections 11901 through 11933.
The Recorder also posts templates for titles that change by affidavit rather than court order: an affidavit of death identifying the decedent as a former joint tenant (Probate Code 210-211) or as the transferor under a revocable transfer on death deed, and an affidavit of a surviving spouse's right to dispose of community real property (Probate Code 13540). A California probate attorney can say whether an affidavit or a court order fits a given title.
BOE-502-D and the Tulare County Assessor
The Tulare County Assessor says the BOE-502-D, the change in ownership statement for the death of a real property owner, must be completed and filed even if the person held the property in a trust. Its form page puts the deadline at 150 days from the date of death or, for an estate subject to probate, the filing of the inventory and appraisal. The same page lists the penalty that can follow: $100 or 10 percent of the taxes on the new base year value, whichever is greater, capped at $5,000 for a property with the homeowners' exemption and $20,000 for one without it.
The Assessor dates the reassessment to the date of death, not the date the property is distributed to an heir or successor beneficiary, and if the house has already been sold to a third party, adjusted bills are issued unsecured to the estate. Its office is also at Government Plaza, at 5953 S. Mooney Blvd. A tax professional can explain what a reassessment means for a particular inheritance.
Step by Step: Selling a Tulare County House in Probate
Each step pairs the statewide rule with Tulare's local practice. A California probate attorney can say where a given estate is in the sequence.
- Step one: whoever holds the original will delivers it to the superior court clerk within 30 days of learning of the death, unless a probate petition was filed first.
- Step two: the Petition for Probate (DE-111) asks the court to appoint a personal representative, usually with full or limited IAEA authority, and moving papers must be filed at least 15 days before the hearing.
- Step three: notice of the hearing reaches heirs, devisees and the named executor at least 15 days ahead and is published in a newspaper of general circulation where the person lived.
- Step four: supporting papers go in at least 10 days before the hearing and the proposed order at least five days before; the examiner's recommendation is posted the day before.
- Step five: after the hearing in Department 2 or 19, letters issue, and only then can the representative act for the estate.
- Step six: the probate referee appraises the house for the inventory, due within four months after letters, and the BOE-502-D goes to the Assessor no later than that filing.
- Step seven: creditors file claims by the later of four months after letters or 60 days after their notice.
- Step eight: with full IAEA authority, the sale follows a Notice of Proposed Action delivered at least 15 days ahead if no one objects; otherwise the representative reports the sale on DE-260, and Rule 1004(b) requires the referee's inventory and appraisal for the sale to be on file two weeks before the hearing.
- Step nine: at confirmation, the price must be at least 90 percent of an appraisal dated within one year of the hearing, and a written overbid meeting the statutory minimum can take the property.
- Step ten: the deed, its PCOR and a certified copy of any confirmation order are recorded at 5951 S. Mooney Blvd., and if no judgment of final distribution or status report is on file within 12 months of letters, the court issues an order to show cause.
