The short answer

Since February 3, 2025, San Joaquin County's Probate Department has been in Lodi, in Department L2 at 315 W. Elm Street, which is also the Probate Clerk's address. Probate examiners post a Probate Note about 10 to 15 days before each hearing, Local Rule 4 requires petitions and supporting papers to be on file 30 calendar days ahead, and the petitioner or counsel must appear to confirm a sale of real property. A California probate attorney can explain how these rules apply to a particular estate.

Probate in Lodi: Department L2 at 315 W. Elm Street

Probate for a California resident is opened in the county where the person was domiciled, regardless of where the death occurred, which puts a San Joaquin County resident's estate before that county's Superior Court. Beginning Monday, February 3, 2025, the court's Probate Department moved to Lodi, Department L2, at 315 W. Elm Street.

The Lodi courthouse occupies two buildings: Department L-2 is the probate department, and Department L-1 handles criminal matters, civil name changes, small claims, civil harassment and municipal codes, along with some probate. Local Rule 4-101 lists 315 W. Elm Street as the Probate Clerk's physical address, and the court says the Zoom link for probate hearings stayed the same after the move. A California probate attorney can say which department a particular matter goes to.

Probate Notes 10 to 15 Days Out, Plus Tentative Rulings

Probate Examiners review all documents for legal sufficiency before the court hears a matter, and the result is a Probate Note posted on the court's website about 10 to 15 days before the hearing. Notes are found on the Probate Notes & Tentative Rulings page by entering the full case number, in a form such as PR-2026-0000123.

To clear the notes, the petitioner files the necessary documents or a declaration responding to them at least one week before the hearing; notes that have not been addressed send the matter to the next available date. Tentative rulings on probate law-and-motion matters post by 1:30 p.m. the day before the hearing, and a party who intends to appear in person or by phone must email probatecourtclerks@sjcourts.org by 4:00 p.m. that day. A probate attorney can explain what a particular note requires.

The Court's Own E-Filing Portal, and a Backlog Notice

San Joaquin runs e-filing through its own eFiling Portal at appfile.sjcourts.org, with nCourt processing payments, and Local Rule 6 requires electronic documents to be filed through the court's electronic service provider. Supported probate filings include the Petition for Probate (DE-111) and the Report of Sale and Petition for Order Confirming Sale of Real Property (DE-260).

The probate page warns of a significant backlog of probate e-filing and asks anyone with a court date in the next 30 days to file in person. A proposed order e-filed with form EFS-020 also needs an editable word-processing version to comply with rule 3.1312(c) of the California Rules of Court. A probate attorney can explain the filing options in a particular case.

Local Rule 4: Thirty Days, Lineal Charts and the Vesting Deed

San Joaquin's probate rules are Local Rule 4, and under Rule 4-101(C), petitions with all supporting papers, other than the notice of hearing and proof of service, must be on file 30 calendar days before the hearing.

Rule 4-107 requires a chart of lineal descent with filings that turn on who the heirs are, including the Petition for Probate (DE-111), the Petition to Determine Succession (DE-310), an Affidavit re Real Property of Small Value (DE-305) and a petition under Probate Code section 850, using local form SJPR-203, SJPR-204 or SJPR-205. When an inventory and appraisal includes California real property, Rule 4-122(F) has a copy of the deed by which the decedent acquired title lodged with it, and a petition for final distribution uses mandatory local form SJPR-208.

Sales have their own rules: the petitioner or the petitioner's counsel must appear for confirmation of a real property sale (Rule 4-104), justification is required for any commission above six percent (Rule 4-205), and a representative with full independent-administration authority who chooses court confirmation must meet the requirements for a representative without full authority (Rule 4-204). A California probate attorney can say which of these rules a given petition triggers.

Recording and the Assessor in Stockton

Probate Code section 7263 makes the personal representative record a certified copy of an order confirming a sale of estate real property, distributing it, setting apart a probate homestead or deciding another title matter, in each county where part of the property is located. San Joaquin's Recorder-County Clerk is at 44 N. San Joaquin Street, Second Floor, Suite 260, in Stockton, takes documents for recording from 8:00 to 4:00, and records them the same day until 4:00 p.m.

The Recorder's ground rules: documents are recorded in the county where the property is located, and a completed Preliminary Change of Ownership Report must accompany any document affecting a change in ownership. When an owner has died, its FAQ says to record the matching form, for example the Affidavit Death of Joint Tenant when the owners held title as joint tenants, and to include the death certificate in each situation. Its transfer tax page says a conveyance a court orders for no consideration is exempt from documentary transfer tax.

The Assessor's forms library page for BOE-502-D, Change of Ownership - Death of Real Property Owner, quotes Revenue and Taxation Code section 480: in a probate estate, the personal representative files the statement with the county recorder or assessor before or when the inventory and appraisal is filed, and in other transfers at death it is due within 150 days after the death. The page also notes a penalty of $100 or 10 percent of the taxes applicable to the new base year value. The Assessor is at 44 North San Joaquin Street, Second Floor, Suite 230, in Stockton. A tax professional or California probate attorney can explain how reassessment affects a particular inheritance.

Selling a San Joaquin County House Through Probate, in Order

The steps follow state law, with Local Rule 4 and the Lodi court's practices noted. A California probate attorney can say which of them apply to a particular estate.

  • Step 1 — The original will goes to the superior court clerk within 30 days after its holder learns of the death, unless a petition has already been filed.
  • Step 2 — For deaths on or after April 1, 2025, a California primary residence with a gross value of $750,000 or less can pass by a DE-310 petition filed at least 40 days after the death, instead of full probate, and in San Joaquin that petition, like a DE-305 affidavit, needs a lineal chart.
  • Step 3 — A full probate opens with a DE-111 petition and its lineal chart, filed in person in Lodi or through the court's eFiling Portal, with every supporting paper on file 30 calendar days before the hearing.
  • Step 4 — Notice reaches heirs and named beneficiaries at least 15 days before the hearing, and newspaper publication begins at least 15 days ahead.
  • Step 5 — The Probate Note posts about 10 to 15 days before the hearing, and responses are due at least a week ahead or the matter is continued.
  • Step 6 — The court's order appoints the representative, whose authority starts when letters issue.
  • Step 7 — Within four months after letters, the inventory and appraisal is filed with a referee's valuation of the house and a copy of the decedent's vesting deed, and the BOE-502-D goes to the recorder or assessor by the same time.
  • Step 8 — Creditor claims can be filed until the later of four months after letters or 60 days after a creditor's notice.
  • Step 9 — The house is sold after a Notice of Proposed Action under full IAEA authority, or by court confirmation, where the petitioner or counsel appears, overbids can be made and a commission above six percent needs justification.
  • Step 10 — The deed, its PCOR and a certified copy of the order are recorded in Stockton, and the estate closes on a petition for final distribution filed on mandatory local form SJPR-208.
