What an Empty House Keeps Costing Its Owner
An empty house still carries a policy, a tax bill and upkeep, and several Valley cities add their own vacant-building rules. This guide sets out what the insurance code, the tax rules and those city codes say.

California's standard fire policy form says that, unless the policy provides otherwise in writing, the insurer isn't liable for a loss while a building is vacant or unoccupied beyond 60 consecutive days, and the Department of Insurance lists losses to a house vacant for 60 days or more among perils generally not covered. Property taxes keep accruing, because all property is taxable unless exempt and every property tax is a lien on the property, while the homeowners' exemption generally doesn't extend to a home that is vacant on the January 1 lien date, with limited exceptions (R&T 218). Cities add their own rules: Fresno requires registering a building vacant more than 30 days, Tracy requires registration within 30 days of a vacancy and Modesto within 60, and Stockton treats a building vacant more than 180 days as a public nuisance unless an exception applies. A California attorney can tell you how these rules apply to your property, and a tax professional can answer questions about your taxes.
Insurance and the 60-Day Vacancy Clause
California's standard form of fire policy (Insurance Code 2071) says that, unless otherwise provided in writing, the company isn't liable for loss occurring while a described building, whether meant for the owner or a tenant, is vacant or unoccupied beyond 60 consecutive days, or while the hazard is increased by any means within the insured's control or knowledge.
Insurers can use different wording when their fire coverage, viewed as a whole, is substantially equivalent to or more favorable than the standard form (Insurance Code 2070), so the vacancy terms in a real policy vary. The Department of Insurance's homeowners guide lists losses to a house vacant for 60 days or more among the perils generally not covered by a homeowners policy, and it tells readers to read the exclusions in their own contract.

Property Taxes Don't Pause for an Empty House
California's Constitution makes all property taxable unless an exemption applies, and every property tax, penalty and interest charge is a lien against the property assessed (Revenue and Taxation Code 2187), so the taxes keep accruing whether or not anyone lives in the house.
A bill that never arrives doesn't change that: state law says failing to receive a tax bill doesn't relieve the tax lien or prevent penalties, and Fresno County tells owners that paying on time is their responsibility.
Fresno County's calendar shows how it works: the first installment is due November 1 and becomes delinquent at 5 p.m. on December 10, and the second is due February 1 and becomes delinquent at 5 p.m. on April 10, when a 10% penalty plus a $10 charge is added. Taxes still unpaid when the fiscal year ends go into default on July 1, which starts the five-year count toward a county tax sale.
The homeowners' exemption, which takes $7,000 off a qualifying home's taxable value, requires the home to have been the owner's principal residence on January 1, and by statute it doesn't extend to property that is rented, vacant or under construction on that lien date, with limited exceptions such as an owner temporarily away after a fire or other calamity, or in a hospital or care facility (R&T 218). Claimants are responsible for telling the assessor when they no longer qualify, and December 10 is the last day to end the exemption without penalty. A tax professional can answer questions about your own bill.

Vacant-Building Rules in Valley Cities
PropertyRadar records pulled in October 2026 flag 1,619 single-family homes as vacant in Fresno County, 1,205 in San Joaquin County and 720 in Stanislaus County.
Cities we buy in handle vacancy differently, from registration programs to nuisance deadlines. Here is what each city's own code or code enforcement page says.
| City | What the city's rules say about vacant buildings |
|---|---|
| Fresno (FMC 10-617) | Register any building that has been, or is expected to be, vacant for more than 30 days, at no cost, and update the registration within 72 hours of a change in ownership or contact information; keep it maintained and secured, with street-visible windows secured only with rigid transparent material, never plywood |
| Stockton (Chapter 15.32) | A building vacant more than 180 days is a public nuisance unless an exception applies, such as an active repair permit or being ready to occupy and actively offered for sale, lease or rent; the property must be inspected monthly, posted with a 24-hour contact sign, and a boarded building rehabilitated within 180 days |
| Modesto (Municipal Code 9-9.601 and following) | Register a vacant building with the Planning Division within 60 days of it becoming vacant, renew every year it stays vacant, and pay an annual monitoring fee; the City also lists unmaintained vacant properties among its common code violations |
| Tracy (Chapter 9.24, adopted March 17, 2026) | Register a vacant building within 30 days of the vacancy; no building may stand vacant more than 30 days unless it is under active permitted repair, ready or being readied for occupancy, being leased or sold, or actively maintained and monitored, and boarding permits are issued for no more than six months |
| Manteca (Chapter 8.18) | A building unoccupied, unsecured or boarded for more than 30 days counts as vacant; it can't stay vacant past 30 days unless it is under active repair, ready to occupy, in the active process of being leased or sold, or actively maintained, and a boarded building must begin rehabilitation within 30 days |
| Ceres (Chapter 6.06) | No building may stand vacant more than 60 days unless it is under active repair, meets all codes and is actively offered for sale, lease or rent, or is properly kept up; the owner's contact information must be posted, board-ups painted to match, and vacant buildings that are public nuisances pay a monthly monitoring fee |
| Lodi (Municipal Code 15.30.030) | Lodi's posted municipal code (codified through March 2025) has no vacant-building registration chapter, but keeping buildings abandoned, boarded up, partly destroyed or partly built for an unreasonable time is an infraction, and such property is declared a public nuisance |
| Hanford (Chapter 8.20) | Registration falls on lenders: before recording a notice of default on a home, the beneficiary or trustee inspects it and, if it's vacant, registers it with code enforcement within 10 days, renewing every year while it stays vacant |
| Merced | Code enforcement covers vacant structures as well as dangerous or substandard ones, and unsecured abandoned buildings are among the violations the City asks residents to report |

Fresno's Vacant-Building Ordinance Up Close
Fresno counts a building as vacant when it is unoccupied or occupied by unauthorized persons, and a multi-unit building when at least half its units are. The registration lists every record owner, the street address and a local contact, and the City can ask for a Vacant Building Plan with the owner's plans and timeline.
Owners have to remove exterior trash within 72 hours of notice and graffiti within 48 hours of its placement, keep the property free of fire hazards and attractive nuisances, and post approved no-trespassing signs. If the standards aren't met within 18 days of notice, each failure is a separate violation, with administrative citations of up to $2,500, then up to $5,000, then up to $10,000 for each following 30-day period until the property complies. An unregistered vacant property draws a citation of $250 a month, and the City can also abate at the owner's cost or ask the City Attorney to seek receivership or an injunction.
A vacant building found in violation can't be occupied until fines and abatement costs are paid or arranged for and it meets the standards for occupancy, and the City may require an interior inspection. Someone who newly acquires a vacant building that falls short of the ordinance has 60 days from taking legal possession to bring it into compliance, and the City may extend that for delays that aren't the owner's fault.
Fresno's weed-abatement program covers vacant lots and lots with vacant structures; when a violation shows no visible attempt at cleanup, the City abates it and bills the owner the cost plus an administrative fee, which the City says averages about $500. A unit in a building registered as vacant under this ordinance is also outside the City's rental inspection program. A California attorney can explain how the ordinance applies to your building.

Stockton's Duties for Owners of Vacant Property
Stockton's chapter makes every owner or person in control liable for violations, regardless of any contract with a third party. The owner or a local property manager has to inspect the property monthly, corporate owners and owners whose primary residence is more than 100 miles away must hire a property management company, and the City can require access to the interior for an inspection.
Vacant properties have to be kept free of trash and piled-up flyers, with pools and spas kept clear or drained, every opening secured and a sign posted with a 24-hour contact number. Violations are treated as strict-liability offenses, enforceable by prosecution, nuisance abatement or administrative action, with civil penalties billed to the owner. A California attorney can tell you which exception, if any, covers your Stockton property.

Vacant House Questions
Does homeowners insurance cover a vacant house?
It may not past a point: the standard fire policy form excludes losses while a building is vacant or unoccupied beyond 60 consecutive days unless the policy provides otherwise in writing, and the Department of Insurance lists losses to a house vacant 60 days or more among perils generally not covered. Your policy's own wording controls.
Do I still owe property taxes on an empty house?
Yes. All property is taxable unless exempt, every property tax is a lien on the property, and a bill that never arrives doesn't relieve the lien or stop penalties.
Does a vacant house keep the homeowners' exemption?
The exemption requires the home to have been the owner's principal residence on the January 1 lien date, and it generally doesn't extend to property that is vacant on that date, with limited exceptions such as an owner temporarily away after a fire or other calamity, or in a hospital or care facility. A tax professional can answer questions about your own bill.
Does Fresno require me to register a vacant house?
Yes, if it has been or is expected to be vacant for more than 30 days: registration is free and has to be updated within 72 hours of a change in ownership or contact information. An unregistered vacant property draws a citation of $250 a month.
How long can a house sit empty in Stockton, Ceres or Manteca?
Stockton treats a building vacant more than 180 days as a public nuisance unless an exception applies, Ceres bars leaving one vacant more than 60 days and Manteca more than 30 days, each with exceptions such as active repair or being on the market.
Can I sell a vacant house that's still full of belongings?
Yes. We buy houses as-is, full of stuff included, and you can leave whatever you don't want; we'll handle the cleanout and the repairs after closing.
